Terms & Conditions

Transparent Agreements, Zero Hidden Surprises

These terms establish a clear, professional foundation for web design, engineering, e-commerce builds, and digital consulting. When you collaborate with BhavaniDev, our shared expectations and deliverables are explicitly aligned before work begins.

1. Acceptance of Terms

By accessing, browsing, or utilizing the website (portfolio-website-65c92.web.app) or by contracting services from BhavaniDev ("we", "us", or "our"), you ("Client", "you", or "user") agree to be legally bound by these Terms and Conditions.

2. Professional Services & Project Scopes

BhavaniDev provides bespoke web development, responsive user interface design, full-stack web applications, e-commerce storefronts, website redesigns, technical SEO architecture, and automated digital workflows.

  • Every client engagement is governed by a detailed written proposal, statement of work (SOW), or project brief outlining deliverables, milestones, and fees.
  • Any requested feature or modification outside the agreed project scope will be evaluated as a change request and billed at our prevailing rates upon mutual agreement.

3. Client Responsibilities & Content Rights

To ensure timely delivery and exceptional quality, the Client agrees to:

  • Provide brand assets (logos, high-resolution imagery, typography), copywriting, product data, and credentials in a prompt manner.
  • Ensure that all text, graphics, trademarks, and content supplied to BhavaniDev are owned by the Client or licensed with appropriate permissions.
  • Provide constructive, unified feedback during designated milestone review windows.

4. Intellectual Property & Deliverable Ownership

We believe in total client empowerment regarding their digital assets:

  • Client Ownership: Upon full and final settlement of all agreed fees, 100% of the customized client-specific deliverables (frontend source code, custom layouts, client assets) are transferred to the Client.
  • Retained Tools & Libraries: BhavaniDev retains full ownership of general developer utilities, boilerplates, open-source libraries, and proprietary engineering scripts used across multiple clients.
  • Portfolio Rights: BhavaniDev reserves the customary right to display non-confidential completed websites, case studies, and design screenshots in our public portfolio, unless a formal Non-Disclosure Agreement (NDA) is executed prior to kickoff.

5. Invoicing, Payments & Deposits

Project fees are structured to provide financial safety and predictable milestones for both parties:

  • A non-refundable deposit (typically 30% to 50%) is required before project commencement and sprint scheduling.
  • Interim milestones are billed as agreed in the proposal. Final website deployment or source code handover occurs upon receipt of final milestone settlement.
  • Invoices are payable within 7 business days via bank wire, ACH, UPI, or agreed digital payment channels.

6. Third-Party Services & Hosting Dependencies

Modern web apps rely on third-party ecosystems (e.g. domain registrars, Firebase Hosting, Vercel, AWS, Stripe, Twilio, Google Cloud). The Client contracts directly with or approves the usage of these providers. BhavaniDev is not liable for third-party service interruptions, billing changes, or upstream API outages beyond our direct control.

7. Warranties, Support & Limitation of Liability

We stand behind our engineering quality:

  • Post-Launch Warranty: All custom builds include a 14-day warranty period following launch to resolve any reproducible bugs or regressions within the agreed scope.
  • Disclaimer: Except as expressly provided, services are delivered "as is" without implied warranties of merchantability or fitness for a particular business outcome. We do not guarantee specific third-party search engine rankings or sales revenues.
  • Liability Cap: To the maximum extent permitted by applicable law, BhavaniDev's total aggregate liability for any claims arising from a project is strictly limited to the total fees paid by the Client for that specific project.

8. Termination

Either party may terminate an engagement upon 14 days written notice if the other party breaches any material term. In the event of early termination, the Client is invoiced for all work performed and billable hours completed up to the date of termination.

9. Governing Law & Inquiries
